When a person dies in Texas, that person’s (called the “Decedent”) estate must generally go through the court process in order to administer the estate. Administering a person’s estate involves determining the identity of the Decedent’s heirs (if he died without leaving a Will) or determining the beneficiaries named in the will. The probate process also involves identifying the assets of the person’s estate, paying any debts owed by the Decedent at the time of death, and distributing the remaining assets to the Decedent’s heirs or beneficiaries named in a Will.
